TERMS AND CONDITIONS
1. ACCEPTANCE OF TERMS
By accessing and using the Ernest Hemingway Fishing Co. (EHFC) website and making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this site or make a purchase. EHFC reserves the right to modify these terms at any time without notice. Your continued use of the site following any modifications constitutes acceptance of the new terms.
2. PRODUCT INFORMATION AND DESCRIPTIONS
EHFC strives to provide accurate product descriptions, specifications, images, and pricing on the website. However, we do not warrant that all product descriptions, pricing, availability, or other content is accurate, current, or complete. Product images are representations only and may not reflect the exact appearance of the finished product. We reserve the right to limit quantities, discontinue products, and correct errors in pricing or product information without liability.
3. PRICING AND PAYMENT
All prices displayed are in USD and are subject to change without notice. EHFC reserves the right to refuse or cancel any order. Payment is processed securely at the time of purchase. All transactions are final unless the customer qualifies for a return under Section 5 of these terms.
4. AVAILABILITY AND ORDER PLACEMENT
Products are offered while supplies last. Order confirmation does not guarantee product availability or shipment. EHFC will notify you of any out-of-stock items or will attempt to cancel and refund the portion of your order affected by stock shortages. We reserve the right to cancel any order for any reason, including suspected fraudulent activity or violation of these terms.
5. SHIPPING AND DELIVERY
Shipping times and costs are estimated and not guaranteed. Delivery dates are provided as estimates only. Risk of loss passes to the customer upon delivery to the shipping carrier. EHFC is not responsible for delays caused by carriers, weather, customs, or other factors beyond our control. Customers are responsible for ensuring accurate shipping addresses are provided at checkout.
International orders may be subject to import duties, taxes, and customs fees, which are the customer's responsibility. EHFC does not cover these additional charges.
6. RETURNS AND REFUNDS
EHFC accepts returns of unused, defective products within 30 days of purchase, provided they are returned in original condition and packaging. Return shipping costs are the customer's responsibility unless the defect is confirmed as a manufacturing error. Refunds will be issued within 14 business days of receipt and inspection of the returned item.
Products with visible signs of use, damage from mishandling, or unauthorized modifications are not eligible for return. Proof of purchase is required for all returns.
7. PRODUCT WARRANTY
Ernest Hemingway Signature Reels are warranted against defects in materials and workmanship for three (3) years from the date of original purchase by the original purchaser, provided the product is registered within forty-five (45) days of purchase. A warranty confirmation email will be sent automatically upon successful registration.
7.1 STANDARD WARRANTY COVERAGE
The Standard Manufacturer's Warranty covers the following components under normal use:
• Main Housing, Frame, and Spool: Cracking or structural failure
• Internal Gearing: Gear stripping or misalignment due to factory error
• Bearings and Drag Systems: Failure to operate within specified tolerances
7.2 STANDARD WARRANTY EXCLUSIONS
The Standard Warranty does NOT cover damage resulting from:
• Neglect: Failure to clean or maintain the reel according to the Owner's Manual
• Abuse: Improper use, over-torquing handles or reel seat locks beyond specifications, lashing the handle or hang grip while fighting fish with the rod in holder, or violations of IGFA rules
• Environmental Damage: Rust or corrosion caused by saltwater exposure without proper rinsing after every use
• Unauthorized Modifications: Disassembly of external or internal parts, or installation of third-party components
• Incidental Damages: Loss of line, lures, or other gear resulting from product failure
7.3 EXTENDED WARRANTY OPTIONS
EHFC offers two optional extended warranty programs for registered products:
7.3.1 Hemingway Competition Warranty (5-Year Extension)
Intended for competitive fishing professionals. Extends coverage to five (5) years from original purchase.
Requirements:
• Product must be registered within forty-five (45) days of purchase
• Mandatory annual certified maintenance service at an authorized EHFC Service Center
Service Fee: USD 95.00 per reel (one-time annual charge). Shipping costs (inbound and outbound) are charged separately and are the customer's responsibility. The service includes labor, parts replacement, ultrasonic cleaning, and marine-grade lubricants. Annual maintenance must be completed within thirty (30) days of the purchase anniversary to maintain extended warranty validity. Failure to complete annual maintenance voids the extended warranty, reverting to the three (3)-year Standard Warranty.
Exclusions are identical to the Standard Warranty, with the additional exclusion that nicks, blemishes, or scratches from normal use are not covered.
7.3.2 Hemingway Heritage Warranty (7-Year Extension)
Intended for recreational and sport fishers. Extends coverage to seven (7) years from original purchase.
Requirements:
• Product must be registered within forty-five (45) days of purchase
• Single certified maintenance service at an authorized EHFC Service Center before the original three (3)-year warranty expires
Service Fee: USD 85.00 per reel (one-time charge). Shipping costs (inbound and outbound) are charged separately and are the customer's responsibility. The service includes labor, ultrasonic cleaning, and marine-grade lubricants. EHFC will send reminder emails thirty (30) days before the three (3)-year service deadline to ensure timely scheduling. The one-time maintenance service must be completed before the expiration of the three (3)-year standard warranty. Failure to complete this service voids the extended warranty, reverting to the three (3)-year Standard Warranty.
Exclusions are identical to the Standard Warranty, with the additional exclusion that nicks, blemishes, or scratches from normal use are not covered.
7.4 WARRANTY CLAIMS PROCESS
To initiate a warranty claim:
1. Product must have been registered via the online form within forty-five (45) days of original purchase
2. Provide a digital copy of your order confirmation number and/or receipt
3. Contact EHFC support at hello@ehfco.com to request a Return Merchandise Authorization (RMA) number
4. Ship the reel (insured) to the service center address provided with your RMA. Customers pay inbound shipping; EHFC covers return shipping if the defect is confirmed
Note: RMA numbers are generated manually by our customer service team to ensure personalized attention to your claim and to gather feedback on product performance.
7.5 LATE REGISTRATION
Products registered after the forty-five (45)-day grace period may still qualify for warranty coverage on a case-by-case basis. Customers with late registration requests should contact EHFC customer service at hello@ehfco.com with their order confirmation and serial number. EHFC will evaluate each request and notify the customer of the decision. Late registration approvals are not guaranteed and will be determined at EHFC's sole discretion.
7.6 PRODUCT REGISTRATION
Product registration is required to activate warranty coverage. Registration must be completed via the online form at the EHFC website within forty-five (45) days of purchase. Registered users will receive a warranty confirmation email automatically and will have access to account-based warranty tracking and maintenance reminders. By registering your product, you consent to receive promotional communications and warranty-related updates from EHFC.
7.7 AUTHORIZED SERVICE CENTERS
Warranty service and maintenance are provided through authorized Ernest Hemingway Fishing Service Centers. Service center availability is currently limited to certain regions; customers should contact EHFC at hello@ehfco.com to confirm service center locations and availability before submitting a warranty claim or scheduling maintenance. EHFC is actively expanding the network of authorized service centers.
Warranty service fees (USD 85 for Heritage, USD 95 for Competition) are collected directly by EHFC and are not collected by the service centers. Shipping costs are charged separately.
8. INTELLECTUAL PROPERTY
All content on the EHFC website, including text, images, logos, designs, and trademarks, is the intellectual property of EHFC or its licensors. You may not reproduce, distribute, or use any content without express written permission from EHFC. "Ernest Hemingway" and related marks are used under license and are the property of the Ernest Hemingway Foundation and Family.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, EHFC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PURCHASE, USE, OR INABILITY TO USE ANY PRODUCT, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, EVEN IF EHFC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EHFC's TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT IN QUESTION.
10. DISCLAIMERS
PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. EHFC MAKES NO REPRESENTATIONS REGARDING THE SUITABILITY, DURABILITY, PERFORMANCE, OR SAFETY OF ITS PRODUCTS FOR ANY PARTICULAR USE OR APPLICATION. USER ASSUMES ALL RISK AND RESPONSIBILITY FOR PROPER USE, MAINTENANCE, AND SAFETY OF PRODUCTS.
11. PRIVACY AND DATA PROTECTION
By registering your product and making a purchase, you acknowledge that your personal information will be collected and used in accordance with EHFC's Privacy Policy. Your information will be used for warranty verification, technical support, order processing, and—if opted in—promotional communications. You may request removal of your personal data at any time by contacting hello@ehfco.com in accordance with applicable privacy laws. Visit our Privacy Policy for complete details.
12. LIMITATION OF REPRESENTATIONS
EHFC makes no representations regarding the accuracy of third-party content, links, or information on the website. EHFC is not responsible for the content or practices of external websites, fishing guides, or affiliate partners. All fishing techniques, methods, and practices described on this site are for informational purposes and should not be interpreted as endorsements or recommendations. Customers use all information and products entirely at their own risk and discretion.
13. INDEMNIFICATION
You agree to indemnify and hold harmless EHFC, its owners, employees, and agents from any and all claims, damages, losses, and expenses (including legal fees) arising from your violation of these terms, misuse of products, or violation of any applicable law or third-party rights.
14. DISPUTE RESOLUTION
Any disputes arising from these terms or your purchase shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflicts of law principles. Both parties agree to submit to the exclusive jurisdiction of the state and federal courts located in Collier County, Florida.
15. SEVERABILITY
If any provision of these terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect.
